Council Denies Request to Rezone

March 6, 2018 – Town of Fairview held their March town council meeting in the town hall council chambers to a standing room only gathering.
First on the agenda was Mayor Darion Culbertson’s presentation of a proclamation honoring the Delta Sigma Theta Sorority, Incorporated Collin County Alumnae Chapter for 10 years of service.
Second on the agenda was to hear a presentation by Ron Cox regarding the results of the Community Representative Group meetings and take any necessary action. During a town council work session held January 8, it was determined that a group of community members would be gathered in order to provide feedback on why the Nov. 17 bond election didn’t pass. Cox’s presentation informed that the group felt the dollar amount on the bond package was more than what was appropriate. It was recommended that the bond package could have been done differently so that residents could vote for separate items not only vote for the whole. They felt the facilities needed to identified and determined if they were being utilized fully. Recommendations included full disclosure on the previous package, disclose financial impacts or alternatives, let the group tour current facilities, allow group input on future projects and fully engage citizens in a future bond election, if called. Mayor Culbertson thanked the group for their input and he said that he believes they have found a model that will work in multiple future projects. Julie Couch, Town Manager, said they plan to take the group to tour the facilities including fire station 1 and 2, public works and town hall. They will get more feedback and present it to council.
The big draw item of the meeting was a public hearing item where council was to “Conduct a public hearing, consider and take action on a request for approval of request to rezone 64.03-acres of land to the (PC) Planned Center District with modified (RE-1) One-acre Ranch Estates District design standards. The site is generally located east of Stoddard Road, between Country Club Road and Hart Road and is zoned for the (RE-3) Three-acre Ranch Estate District, (RE-1) One-acre Ranch Estate District and (PC) Planned Center District for the Fairview Country Day School. Applicant: Stephen DiNapoli, DiNapoli Development, LLC representing Shannon and Robert Kelly, Diane and Michael Pezzulli and Mark and Morgan Stoddard.”
Israel Roberts, Town of Fairview Planning Manager, said that the town had received 14 letters in support, 143 letters of opposition and 1 neutral letter regarding this action. In February, the planning and zoning committee had denied this request. Mayor Culbertson denied a request for a continuance until April because “council has enough information to make this decision.”
DiNapoli discussed the hike and bike trail, the water features and that there would be only 41 lots on the property instead of the 42 initially planned. He said they wanted to make this something the community would be proud of. He informed that they did a traffic analysis and concluded there would be no negative impact. Fire equipment would be able to access all streets. Puster Elementary wouldn’t be burdened by the increase of students if these homes were built. The average home cost would be over a million dollars which would generate dollars for LISD and the town of Fairview. He said they are attempting to be good stewards of the land.
Resident after resident spoke during the public hearings voicing their opposition to this action. A single father with a young son started the comments stating that he moved to Fairview so that his son could attend Puster Elementary. Three years ago the school had a 13-1 teacher/student ratio, now that ratio is at 19-1. He was concerned that if that number continues to rise LISD will lose its luster. Multiple residents brought up their concern over increased traffic if this action is passed. Many people brought up the fact that they moved to Fairview because they believed that Fairview was going to keep it country. Now they say they sit in bumper to bumper traffic. A resident queried whether an environmental impact study had been done. This person also wanted to know if traffic concerns had been coordinated with neighboring cities. Roads of concern were Country Club, Hart and Hwy 5. Mention of the increased traffic due to the yet to be built townhomes was made. Mayor Culbertson said that they are working with TxDOT on upcoming changes to Country Club and Hwy 5. One resident said they bought their home based on what was around their home and asked the developer to “…go back to the drawing board and bring something more palatable to the neighbors.”
A few voices of support were heard. A resident said, “I have lived here 14 years. The mall is half empty…folks, we don’t have country anymore. These owners have kept it country longer than anyone else.” One resident requested the town be fair and not bow to public opinion. One resident said that the Kelly’s are great neighbors and should have the freedom to sell his property.
After much discussion, the action was unanimously denied by town council.
